This Terms and Conditions of Use Agreement (“Agreement”) is a binding legal contract between you (“User,” “you,” “your”) and Gomez Cardiovascular, including its affiliates, subsidiaries, successors, assigns, and related entities (“Gomez Cardiovascular,” “we,” “us,” “our”). By accessing or using our websites, portals, applications, telehealth platforms, patient portals, social media channels, or any other service, product, or resource provided by Gomez Cardiovascular (collectively, the “Services”), you agree to be legally bound by this Agreement.
If you do not agree to these Terms, do not use the Services. Continued use constitutes full acceptance.
1. DEFINITIONS
1.1 “Content” – all text, graphics, images, video, audio, software, data, and materials displayed or made available through the Services.
1.2 “Third-Party Tools” – any external platform or technology integrated with or linked to the Services, including but not limited to analytics tools, scheduling platforms, payment processors, accessibility and translation tools, advertising tools, and medical technology integrations.
1.3 “Healthcare Provider” – a licensed clinician affiliated with Gomez Cardiovascular.
1.4 “User-Generated Content” – any text, images, data, or materials submitted by you through the Services.
1.5 “Force Majeure Event” – any event beyond reasonable control including natural disasters, pandemics, cyberattacks, system failures, governmental actions, or other unforeseen circumstances.
2. MEDICAL DISCLAIMER – NO PROVIDER–PATIENT RELATIONSHIP
2.1 The Services provide educational information only and do not constitute medical advice.
2.2 Use of the Services does not create a patient-provider relationship.
2.3 Always consult your physician for medical concerns.
2.4 In an emergency, call 911 immediately.
2.5 Your reliance on any Content is at your own risk.
3. ACCEPTANCE & MODIFICATIONS
By using the Services, you confirm you are 18 years or older or have legal guardian consent. Gomez Cardiovascular may modify this Agreement anytime. Continued use means acceptance of changes.
4. THIRD-PARTY TOOLS & DATA PRACTICES
Gomez Cardiovascular may use third-party platforms for analytics, marketing, scheduling, financing, language translation, accessibility, and operations.
Use of the Services means you consent to data collection and processing by these third-parties under their own privacy policies. Gomez Cardiovascular is not responsible for third-party privacy practices, performance, or security.
Gomez Cardiovascular disclaims all warranties for third-party tools and shall not be liable for damages arising from their use. We may modify or discontinue third-party integrations at any time.
Users assume full risk when using third-party tools and acknowledge possible cross-border data transfers.
5. USER RESPONSIBILITIES & PROHIBITED CONDUCT
Users may not:

Engage in illegal, abusive, threatening, fraudulent, or harmful conduct

Share Protected Health Information (PHI) via unsecured channels

Infringe intellectual property rights

Interfere with site security

Attempt unauthorized system access

Upload malware or malicious code

Engage in spam, phishing, impersonation, or data harvesting
Violation may result in termination and legal action.
6. PAYMENTS & FINANCIAL RESPONSIBILITY
Payments processed via third-party vendors are the user’s responsibility. You remain financially responsible for all service costs, regardless of insurance coverage.
7. USER-GENERATED CONTENT LICENSE
By submitting content, you grant Gomez Cardiovascular an irrevocable, royalty-free license to use it lawfully and confirm you own rights to it.
8. TELEHEALTH & COMMUNITY TERMS
Telehealth may involve risks including unauthorized access or technology failure. Use is voluntary and at your discretion. Any participation in community engagement platforms is at your own risk.
9. DISCLAIMER OF WARRANTIES
Services are provided “AS IS” and “AS AVAILABLE.”
No warranties of any kind are made regarding accuracy, security, reliability, or availability of services or medical outcomes.
10. LIMITATION OF LIABILITY
Gomez Cardiovascular is not liable for indirect, incidental, consequential, punitive, or special damages including loss of profits, data, business interruption, or emotional distress.
Total liability shall not exceed the amount paid for services within the prior six months or $100, whichever is greater.
11. INDEMNIFICATION
You agree to defend, indemnify, and hold Gomez Cardiovascular harmless from claims arising from your use of the Services or violation of this Agreement.
12. FORCE MAJEURE
Gomez Cardiovascular is not liable for delays or failures caused by events beyond reasonable control.
13. DISPUTE RESOLUTION
All disputes shall be resolved by binding arbitration. Class-action participation is waived. Venue shall be in Texas.
14. SEVERABILITY & ENFORCEMENT
If any provision is invalid, the remainder remains enforceable.
15. GOVERNING LAW
This Agreement is governed by the laws of the State of Texas.
16. ENTIRE AGREEMENT
This document constitutes the full agreement between you and Gomez Cardiovascular.
